No a very good explanation. He elaborated more on case laws than explaining what loss ofnuse actually is and covers. Im an insurance agent and what it does is it keeps you from exceeding your monthly expense for lodging. Basically it covers any amount that exceeds your normal monthly payment for rent.
@@saintclairepatriz it does not cover an amount that exceeds your normal monthly payment. Gosh, people should be scared if you're an agent. Loss of use is if you are displaced from your home. It will provide funds to live at another place. Has nothing to do with what you currently pay other than trying to get a house for $10k month and your mortgage is $5k a month won't swing it. It should be apples for apples. Again, you need to know this if you're an agent
@@theclaimsquadpublicadjusters loss of use will only reimburse you for expenses that are above and beyond those that you would incur if you lived at home. Many agents do not know this, they just bind policies. It's best to speak with someone in claims.
@@saintclairepatriz your living expenses are associated with ALE aka Additional Living Expenses that is different coverage and definition from Loss of Use
@@theclaimsquadpublicadjusters but it's very important that renters know that it's not as simple as " it pays for you somewhere else to live". It's also important that they know that it's on a reimbursement basis so one will be reimbursed for only the amount that exceeds his/her rental amount unless there is an actual $$ limit defined in the policy.
I also think that it's very important to define your audience. Are you speaking to RENTERS OR HOMEOWNERS. That of course changes the focus. Be clear.

What if there was some damage before the hurricane but was made worse or exacerbated by the hurricane? I just went through Hurricane Beryl just one week ago and I live in the Houston Texas area. I already had some deterioration of the siding and exterior trim but was made worse by the hurricane. In fact, one whole section of siding was ripped off by the powerful winds of Hurricane Beryl. I'm a little afraid that the insurance company is going to try to tell me that because my siding was in poor condition before the storm, they will not cover the cost of replacing it and they will not cover any water damage caused by the storm. I'm afraid of them telling me that because I was "irresponsible" by not replacing the siding sooner, that they will not cover the storm damage.
@@vigorousboredom7016 there is a possibility of that if they know there was damage to your home before the Hurricane. Understand it would be difficult to show what was damaged prior to Hurricane and the damage caused by the Hurricane to justify any payment
@@theclaimsquadpublicadjusters I am also afraid that an adjuster from the insurance company would also take advantage of the storm damage inspection to make a list of all the things wrong with my home and report it to the insurance company. Hey Florida! You live in hurricane state! Nobody forced you to live there or take out a mortgage to buy a home. The rest of the country does not carry hurricane coverage. YOU DO! You are complaining that HURRICANE coverage is expensive. Boo hoo! Move!

I do not live in Florida. I am a licensed insurance professional with 35 years experience. I just hate LIES. I also refuse to have anything to do with FL home insurance or MI auto insurance because both states are crazy. Once again, 150 million in profit vs billions paid out in claims. Insurance companies are not ripping anyone off in FL. Earning a few million in profit will not make up for billions paid out in claims. You all want great coverage but don’t want to pay for it.
@@melodystaub9763 ahh so the truth comes out An insurance agent who loves to screw people by your own failure to tell them the lack of coverages insurance companies provide because you guys don't actually know anything about what's in those policies . I see this all the time and we actually have at least 8 current E & O lawsuits against agents like you for not telling ppl they don't have certain coverages. I also see you are not very keen on accounting or have any idea how it works. You do realize that $150 million in profit (as you stated) can be manipulated to be more or less. Based on that $150 M their actual profit I would bet is 10x that number.
This guy is LYING to you. All insurance carriers writing homeowners insurance in Florida only made 150 million in profit in 2023. That is ALL insurance companies combined! In 2022 insurance companies paid out 1.53 Billion in claims. In 2021 they paid out 1.8 Billion. Source: Fortune Magazine, NOT insurance companies. The math doesn’t math dude! You lie!
I discovered that my family committed home insurance fraud against Heritage. Fraud is punishable by jail time folks, so before you hire an "adjuster" to lie for you, think about the huge fines and jail time, not to mention the fact that any insurance company can drop you if they find evidence of fraud. Just stop lying people, and especially adjusters. Get a job that actually helps people in an honest manner. I am sure that my "family" learned how to conduct insurance fraud from coworkers and friends. This hurts all of Florida.
Great video
Mike! I need your help. Been watching your videos these past couple of weeks. So my family left for about a week. When we can back the house was dripping with water everywhere this causing damage to the ceilings and walls. We got a restoration company to come and check what’s going on and the found that the first pipe of the ac unit stopped working and the water went into the emergency drain pan. But due to debris build up the drain pipe started to overflow and pour into the house. Our insurance is trying to deny the claim what do you think about this situation? Could I fight it or should I accept the denial?
I would still fight it They prob going to argue lack of maintenance Where are you located?
@@theclaimsquadpublicadjusters I’m located in Texas. How do I fight the lack of maintenance statement? The direct cause was due to the sudden stoppage of flow from the main line, but the damage occurred due to the blockage from the drain pan. I don’t know what evidence to support the sudden and accidentalness of the first pipe. And I’m having trouble finding how to argue there was no lack of maintenance. You suggestions would be very helpful.
@@busayoo8949 give me a call to discuss in greater depth I have some questions
Nearly every homeowner's insurance policy includes coverage for sudden and accidental loss, which is exactly what water damage from a running faucet is considered to be. It doesn't matter whether or not it was your own fault or that of a small child playing on his or her own. Is this accurate?
If the faucet was left on accidentally they will likely not cover it . There has to be something that causes the water loss like a breakage, crack, when referencing loss from a plumbing, AC, or fire protective system. If the faucet was leaking because there was a crack somewhere then yes it will be covered. You will have to show what was repaired by a plumber. Policy will not cover your own neglect whether that was known or unknown neglect by you, a dog, friend or family member
Does insurance cover water damage due to a bath tub accidentally being left on in the upstairs bathroom?
This just happened yesterday. I am filing a claim today
It does not cover negligence by the homeowner A covered peril needs to occur for coverage: Wind, Fire, Sudden leak from like a pipe break, hail, etc

Any mitigation company without an Assignment of Benefits shouldn't be trusted. AOBs are a necessary layer of protection for these companies to make sure that customers don't have legal grounds to run off with money gained as a function of your estimate and work. That in tandem with lien rights are the ONLY protections these contractors have to make sure they get paid. Even then they many times aren't effective enough. AOBs also streamline payment so that financial institutions don't behave as middle managers delaying payment to a degree that sometimes causes liens to be filed. It also prevents a customer's personal financial situation from impacting the payment of insurance money to the contractor. This advice honestly only applies if you are a customer who wants to commit fraud or make profit on your claim. Both of which are unethical.
lol, the mitigation bill is the mitigation bill. I have seen an insurance company take deductible out of mitigation check before. This advice may be slightly too broad. I think the advice is more, "wait until you know who is covered by who and where the deductible is being taken out, before paying your deductible TO ANYONE."
Very useful information sir…..I fell down the stairs when landlord illegally shut off the electricity, I was assaulted with a shovel by his son, and forced out right after major surgery. You want the skinny on how long a lawsuit takes (seeing this guy is beating around the bush and never quite says it), read your attorney-client agreement. "Results not guaranteed" very rarely will the court award attorneys fees and you can expect up to 3-4 years before a settlement is reached. Tack on another year if the attorneys want to take it to court.
