He's not a sith. He said a jedi like you would call me a sith, showcasing how the jedi refuse to allow anyone else to wield the force. They label anyone who refuses to bow to the order and accept their ideals as evil. They are essentially a violently religious cult. He never called himself a sith, he just said he wants freedom to wield his power without answering to jedi. That's not very in line with the true sith ideals. He also said he accepted his darkness, making him more in line with someone like mace windu who accepted and wielded both the light and dark sides of the force
