I have notified Etsy about this situation, so perhaps they as a larger corporation can have some pull with Shopify to rectify some of these issues. Here's hoping.

Doing a quick whois search, it looks like their registrar is in Iceland, something called Name Cheap. Sometimes if you write to the registrar, they may take the site down - just another tactic to try.
Yes, I believe my husband has also filed a DMCA with Name Cheap, but they too don't often take any notice unfortunately.

Thank you so much for this information as I just signed up for a shopify store (not active yet) to start selling digital products as well as POD of my own artwork. I think I am definitely going to be doing due diligence reasearch on how the different ecommerce platforms are protecting designers and artists. It is so sad that we live in a world where people would rather put time and energy into being criminals (theft IS a crime) rather than create something that comes from them and leaves a proud legacy of their accomplishments. I am sorry that this has happened to you and I hope that @shopify corrects this mistake as well as making changes to their policies (such as verification processes)

I don't know if this is worth trying, but the DMCA only protects platforms when they have taken all reasonable steps to protect the copyright of the work i.e. they actually gave you information that would allow you to take legal action against them for stealing your work. Because the person obviously gave fraudulent information, if you present that to Shopify and they do not honour your takedown notice, they are now legally on the hook. I would remind them of that as well as you might be interested in a class action because you best believe if they've done this to you they've done it to others. That might be enough for them to do their job and actually take it down.
I feel like I"m playing DMCA "tennis"...filing DMCA takedown notices, which are applied, then immediately receiving a counter claim notice with the same fake info. The items are also immediately relisted with only a "-1" or "-2" added to the links. For example, yarnora.com/products/waves-2 I looked further and saw an option on Shopify to report a site for "Fraud" so I have done that. The reply was: Hello Lisa van Klaveren, This email is to inform you that we have received your submission regarding Scam. We will investigate and take further action if warranted. Please note, you will only be contacted should we require further information. Thank you, Shopify
This is terrible. Online platforms hosting these scammers should be held accountable. Wasn’t there a bill in US just for this but the Tech companies lobbied against it? All designers in every craft from yarn to wood & gems should become a group just to get this bill passed. All legal expenses should automatically be paid by scammers. Thank you for bringing this serious problem to public. 💖🌹
If you think of how vast the crafting community is (even just crochet - my area specifically), we are a large group to have a voice, for sure.
Certainly doesn’t make me want to use Shopify for anything I’ll tell you that.
This happens all the time to artists and designers. You have to sue, but because it's so costly, nobody does anything. So these people will always get away with it, and that's the end of the story. I try not to search for my work because it depresses me to see all the scam sites selling my designs.
Yes, I don't search for my designs being stolen online either...too busy creating new ones. :) Just take care of the scam issues when alerted to them, if I can.
From what I understand methods like patterns and recipes etc can't be copyrighted but photos can. If the photos were stolen that's the best way to get this righted.
There's a difference between someone taking your design and recreating a copy, changing a stitch or 2, etc. This is rather sites selling your actual PDF with your copyright and name printed on it.
@hollanddesignscrochet legally I don't think so. I'm not saying it's morally right but there are not legally binding copyright protections on written patterns or recipes, building instruction etc. That's why they put the rebuttal forward because they know that. It's cruddy
If you have your name trademarked you can legally go after it for that fact, but not the pattern copy itself unfortunately!
The legality designers with "copyrighted" patterns refer to is simply "thou shalt not steal", not some specific law on books created in a courtroom of men. The DMCA report does allow you to report the stolen product in addition to the images.
No, a pattern can be copyrighted but it cannot copyright things like stitches or techniques. If someone uses the exact same pattern as you without any change at all, doesn't matter they wrote it down on a new piece of paper because you own that pattern. If however someone sees your pattern and adapts it/modifies it/makes their own tweaks to it, this is derivative and falls under fair use. The best way I know how to show how copyright does and does not work is copyright protects implications and unique expressions of an idea, not ideas or tropes themselves. A specific written pattern is an implementation and therefore copyrightable, but if someone else takes the same idea and does it similarly but differently, this isn't infringement because it's the idea they are taking, not the work of that specific implementation. That all being said, enforcement of your copyright is a civil issue and expensive and easy to lose even if you have a good case of you can't afford the right lawyers.
This is heartbreaking.These platforms need to catchup and help creatives. DMCA is simple to prove, I don’t understand why they are making you jump through hoops.

I’m so sorry this happened to you. It takes a lot of work, skill, and time to create a crochet pattern. It seems like unethical behavior is running rampant and original works are getting stolen. Can the images you use in a pattern be copyrighted?
Everything a creator makes belongs to them...copyright is on the pattern and the images may not be used without permission. Scammers don't care about copyrights.
Can you place a Watermark across your patterns? I have seen this done by some designers and they stated it was an added protection to secure their patterns from possible theft.
It doesn't deter thieves, no, but also craft companies and even Etsy discourage you from putting watermarks on images as it detracts from the image. Also, thieves steal project photos left by reviewers.
You have some really nice patterns! May Lord Jesus put a stop to the scammers and may they never get a dime. Also, may consumers be wise and actually research about a website or seller or product so they don't get scammed. Amen. Saints please pray because the useless ones in charge of the website don't do anything.
I'm UK based Etsy seller & man this has put me off opening a Shopify store. I sell physical products, but have had my designs/product names stolen on numerous occasions & it sucks. I have a 6 digit postcode, so 6 digit codes do exist, but this postcode is clearly bogus. 'E' stands for east London & there are numerous postcodes within that area using just the letter E, but there is definitely no E23 in London or anywhere else in the UK. That postcode generator bit of sleuthing was a good! I hope Shopify can look at all the evidence, including the info you found from another designer, to help rule against the faker. They absolutely could & should put as much time & effort into protecting legitimate designers/makers as they do with their advertising.

It really is so depressing that we live in a world now that people don't want to work to make their own money or be proud of their own accomplishments and stealing from the little guy has become the norm even for big corporations. I hope you get this rectified sooner rather than later. And i know it isn't much but i will be subscribing to you from this point forward. You shouldn't have to fight for what is rightfully yours. That’s not a real postcode, even as a generated postcode it’s clearly wrong. But as a UK resident I recognise that immediately. Copying designs is everywhere, I have a friend who designs jewellery and she had a customer contact her to say they’ve just seen her design on the jewellery channel.

Instead of taking out a court order against the scammer, could you take one out against Shopify, insisting they do not reinstate those listings? I realise this may not be feasible, I'm not legally trained, but it was just a thought.
Sometimes the "court of public opinion" has more of an effect on what large corporations do than actual court orders.

Thank you for this post. I buy patterns online most of the time and have been hearing about this issue. I will only buy from designers who have a long presence on the internet. I know this hurts new designers but I do not want to contribute to criminnals.
We do have 5 and 6 digit post codes as well as 7 digit post codes. The letter at the front stands for east 23. If it was south east, it would be a 7 digit cos it would be se23. This is a like wise post code areas like e4 exist which is a 5 digit postcode. However e23 does not appear on the east London map postcode
Yes, the more I looked online about it, I realized I didn't understand UK post codes, but I knew it wasn't legitimate. The phone number given also was inactive and invalid when we called it just out of interest.
Watermark your patterns. Sorry this occured to you.
The patterns are all copyrighted, yes. Many craft company sites do not allow watermarks on images used on their sites since it detracts from the appearance of the item.

Hi! Your video came up, probably because I visit other crochet sites. I found myself working up for a fight! Well, figuratively speaking. You have absolutely gorgeous patterns and I plan on buying some. But that's not why I'm commenting. Like other media artists, I would encourage you to copyright your patterns. Your patterns would have © on them and only you would have the right to sell a digital copy, in addition to prohibiting others to sell and incur a lawsuit. I plan on looking into it for myself for fabric pattern designs. I do not know the cost to copyright a design. Another issue is that they are making money off of your patterns. Shopify may not be able to do anything on the legal end, except to send out letters of reproach. Frankly, if no one pursues the scammers legally, it will continue... and they win. Please don't let them. I hope you can get some legal advice on how to proceed.
Yes, a copyright is on every pattern I produce. The PDFs they pass off as their own will all have my copyright on them clearly for anyone to see.

All this blatant thievery is so very wrong; but, unfortunately, it’s a sign of the times in which we live. Integrity, honesty, accountability, honor, and the like seem to be values that are no longer purposefully taught and enforced in our homes and schools. They’ve been replaced by greed and entitlement . It’s more than just sad, it’s despicable and abhorrent.
Yes, you are correct. I had a mother who not only taught me to crochet and bake but also instilled moral values. My father also taught me honesty in business by his own example. They both had very strong work ethics and moral values.

My husband was finally able to gain access. They currently have 2 pages of crochet patterns up there. They are repeat offenders and in breach of Shopify policies, so it will be up to Shopify to shut them down and some of their other scam sites.
I'm am so very sorry this happened to you. That is so wrong. Another issue I have found that you and other creators need to be aware is whole channels being hijacked by political content. I have no idea how that happens but just be aware.
I get ads for crochet patterns on Facebook from time to time. I always do a reverse image search on Google to see if it is a stolen pattern. It almost always is. I go to the etsy store of the actual designer and purchase there. I know that so many people are fooled by these ads. I try to report the ad to Facebook as a scam.
Sorry this happened to you. I'm mainly a knitter but have recently rediscovered my love for crochet too. My gran and my best friend taught me when I was 10 (I'm 71 now!!). The internet is a good thing for info from legit sites but sadly those people who are morally bankrupt and only care about money will use and scam others. I have never bought a pattern online because I have bought patterns and magazines and books in shops (I'm not very computer literate and only have a phone and a tablet so downloading PDFs is not really practical.) Your video popped up on my feed because I watch lots of crochet channels so hopefully it will pop up on other crochet podcasters/designers channels too and also get you some new subscribers too... like me!!

This applies to any craft community. Some people have the ability to duplicate a pattern just by looking at the item or a picture of it and if it is clear enough duplicate it. I have taken Pictures of a piece off the internet, enlarged it, and modified the pattern in small ways to make my own piece have a unique appearance. But i an not selling these pieces on shopify. When i began doing consignment work many years ago i made it a rule that the person wanting the piece done had to give me a printed pattern, yarn, and any notions that go with it. This protects me from being accused of stealing another person's designs. ( yes i have redirected angry people to someone i am doing the piece for, i am just the "hired help", not the originator of the agreement.)
Yes, it applies to may crafters and artists. I have always stated that anyone may sell what they make using any of my designs. As a designer, my wish would be that a maker could benefit from what I have designed using their own talents and skills. My designs are not generally something that could be reproduced from a photo necessarily. I do know other designers have different rules and feelings about these things.
I am very sorry this happened to you. I retired from crochet designing before Etsy and Ravelry. My designs were stolen by a store owner in SF. At this time I primarily sold at the Berkeley sidewalk craft fair on weekends and holidays. I stopped doing consignment when a famous SF shop not only didn’t pay me, but had street kids making my designs. I found out when one of the shops customers saw an item she’d purchased in SF in my display. She berated me for the poor quality of MY work. We compared the two items and she saw that hers was a poor knockoff of mine. A wonderful jewelry designer had her work ripped off by a big company. She tried to sue and lost. All her money went to lawyers. There are big name designers who go to rat fairs to get “inspiration” for their designs, which are exactly like the ones they bought on the street.

I've been crocheting for 55 yrs and pattern theft was a thing back then, too. If you want something I've made, I will give it to you if you catch me in the right mood OR you buy the yarn, bring it to me anf I'll make it. Problem solved! I despise Internet intellectual thieves. Your work is lovely.
