My partner had a summary offense that was dismissed and she thinks it got sealed on its own by the state of PA since it was a case dismissed and doesn’t show up on a PSP case report anymore, does that mean after 5 years it will automatically be expunged as well? Or what happens next?
The summary offenses MIGHT have been expunged by the PSP. Without knowing what was on your record, all we can do is quote $100 to request a PSP Full Access Review to get a complete history and see if it is there. Hello everyone i am working with this lawyer. Mr. Walmar i file my application in 2023. I should be hearing something soon in july hopefully regarding merit review or maybe 2026. Idk how helpful, but he charges 3100/ pardon that he says takes 2/3 years to get cleared with no way to financially expedite the process. I believe the sales pitch went something along the lines of : after u pay us we keep track of the court dates , file the paperwork & notify you went it’s time for court 2years .” I’m not knocking his hustle at all , I just rather not spend 3100 to have someone file some papers an keep track of court dates an responses. Just me ! The expungement process ( which is wayyy faster ) will cost you about 1700 Keep your paperwork organized Do a little research & get active ! Good luck ppl

What's going on at the BOP with expedited marijuana pardons? I sent in my application on 11/2023, got the questionnaire on 4/24 and still no news. I emailed them recently and they said the process takes about 2-2.5 years.. I though that was the point of expedited.. I could see a year, but its unreal it takes this long.
More and more people are asking for pardons - it is stretching out the review time. There are only 5 people reviewing all these applications. I wll keep an eye on them and post as possible.
Are you referring to the timeline from the date they received the application or from the date they considered the application filed? Also are you referring to the convictions timeline from date of charge or completion of sentence? Thanks
I always refer to the timeline from when the pardons are sent to the BOP by us, not when they mark it 'filed'.

Fresh cases should try to avoid conviction. If it becomes a conviction, clearing it will take 5 years or more.

There is definitely a bottleneck in the process due to the high volume of pardon applications submitted to the Board of Pardons. Our office is in close communication with the BOP on how we can support them in improving the timeline.
Can you apply for both commutation and a pardon in the same application?

Brandon Flood is truly a great man. Thank God for the ambitious work he did during his capacity on the PA BOP, and the work he continues to do. I have a case from 17 yrs ago (when I was 20). I submitted my application today, after putting it off for years. My husband will be police chief next yr and personally knows Flood, along with other PA officials. Fear of smearing his reputation has deterred me from going through the process. Today I woke up and decided I was done living in my own personal prison I’ve created, due to the stigma associated with my history. I submitted my application today and placed it in God’s hands 🙏🏼 this was a very informative interview that I wish more people in my situation could find and watch!

1 st it should not matter if a person mad mistakes in his or her per. If they did what ever time then they should be aloud to have their rights back, ITS A CONSTITUTIONAL RIGHT for all American. Personal i feel what we are doing to crimes is being decimated at people with a record. They should have right to protect their family their self and the right to hunt for food. ( But they have to pay taxes not Right give all felony their right s back)
I agree in general that once a price is paid, the person should not be held back. The system is disempowering and does not know how to fix itself.

I wish this was possible in the state of Massachusetts. When I was 19 violated probation which turned everything straight to guilty. Sentenced to 45 days released after 30 days. Never had another arrest again almost 30 years later and the immature choices still haunt and prevent many things. Nothing violent yet the state took my conceal carry and all state firearms rights away. Was able to get my record sealed but that only seals it from public and does not reinstate your rights to 2a. Cannot understand how a state can sentence you then strip your constitutional rights after you’ve paid that debt to society. If it was violent or sexual offense I’d understand but that state uses any offense to disqualify you. Heading toward 30 years of no issues and if that doesn’t demonstrate a change to law abiding citizen idk what does. The mind of an immature teen has the adult nearing 50 years old still paying the price. There really should be doors available to redeem yourself. @@recorderaser9938 I will seek a lawyer one day but in the state of Massachusetts it’s quite rare to win an expungement and a pardon from the governor is unheard of. They want to outlaw guns in MA so they enjoy not giving pardons and expungements. There is the newer youthful offender law that allows them to expunge if under 21 when it happened BUT if you had 2 arrests or more you don’t qualify. I have a friend that had a fight with someone at 17 years old and the case was done at 18 and he cannot get a firearms permit or carry permit because he also had traffic violations over 500 dollars. The state doesn’t believe in rehabilitation and most definitely doesn’t respect the constitution either. Thanks for your reply.

I have a felony marijuana charge for PWID. It’s been 10+ years since my conviction. I haven’t been in any trouble since. How would i go about trying to have my gun rights restored? This happened in PA by the way.

A PA misdemeanor could receive a pardon after a number of years. It needs to be evaluated. You could be hunting again.
