Thank you, does the guide have to be the up to date version, and if it's an old one is issued to the tenant when they move in does it invalidate a Section 21?
The landlord must provide the tenant with the current version of the How to Rent guide as at the date it was given. If an out of date version was given at the start of the tenancy then it could invalidate a subsequent section 21 notice because the landlord would not have strictly complied with The Assured Shorthold Tenancy Notices and Prescribed Requirements (England) Regulations 2015, paragraph 3. The landlord can give the tenant the current version at any time before the section 21 notice is served. Many thanks

Hi, the best thing to do is to contact the HMRC IHT helpline on 0300 123 1072 You will need the IHT reference submitted within the IHT400 handy when calling. Thanks Brachers

I understand IHT must be paid prior to grant of Probate. However, do you need to wait until the IHT is paid in total if you opt to pay the IHT over a 10 year period, or can you apply for Probate after the first installment for IHT is made?
Yes, you can apply for probate after the first instalment of the IHT has been paid, provided reference is made to using the instalment options for payment of IHT on the form IHT400. You will usually have to pay interest on your instalments. You should also bear in mind that the IHT has to be paid in full when the deceased’s assets such as a property/shareholdings have been sold. The first instalment of IHT is due on the “due date” being at the end of the sixth month after the death (for example if they died on 12 January, you’d have to pay by 31 July). Payments are then due every year on that date for the remainder of the instalment period. An executor can apply for probate before a property in an estate is sold and in fact it is normally the case that a grant of probate is required to authorise the sale of property in an estate so usually comes first. Any idea how long grant of probate currently taking we are purchasing a property waiting on grant so we can exchange and complete , currently into week 8 since application was started , Apparently they were sent out a form to sign and return to probate 2 weeks ago but not sure what that would have been ?
Hi. We are currently seeing a real difference in timescales for a Grant to be issued. If it is a straightforward application which did not need to go to HMRC and without queries raised by the Probate Registry, then we are finding that we are receiving the Grant of Representation sooner than the eight week timescale given by the Probate Registry. However, if they raise a query (as it sounds like they have done here) they are taking much longer than this and it is a case of chasing them, where appropriate. Please can you advise how to go about disclaiming an inheritance (in UK), either by conduct (UK government website says you can, but no one seems to know about this and I will be very impressed if you can find out how), or if by writing, what would I write and who would I send it to? Would doing this release the person from being administrator of the estate?
We would advise for a disclaimer to always be done in writing. If you would like advice on disclaiming an inheritance we would be more than happy to help - please get in touch via email on hello@brachers.co.uk or call 01622 690691. By disclaiming your inheritance you would not receive any benefit. It would not impact the administrator in their role of administering the estate it would only impact on who they distribute assets to.

Hi Mohamed, the first step you should take is to check the terms of your lease to see whether there any provisions about buying the freehold, as commercial leaseholders don't have the same legal rights to buy freehold that residential leaseholders have.
