Kanoon to accha hai ,par lagoo nahi hote and lagoo nahi karne diye jate hai.

My son's wife has filed a false complaint under PWDVA accompanied by a false affidavit 7 years ago. The trial is yet to start. Interim maintenance was awarded immediately and after paying for a few years he stopped paying as the case was not going anywhere. Now there is an arrest warrant out for him u/s 125 CrPC. In her affidavit she has lied about his salary by including a prestigious grant in his salary thereby inflating it by 50%. His true salary has been accepted by the DJ and HC where quantum of interim maintenance was challenged. She has even lied about marriage expenses saying 2 cr were spent while her father has submitted an affidavit to income tax saying he spent 28 lacs. We asked her to back her stridhan lying with us 3 weeks before filing the complaint but in the complaint she has hidden the letter and accused us of misappropriating this as well. JM is disinclined to listen to us because of default in payment. She has also filed a false rent agreement to claim money for alternate accommodation. A notice sent to this address came back with the comment "No such person at this address." Can / should we file an application u/s 340 before the JM? Will he take cognisance of the same? Kolkata lawyers say nothing will happen.

सिविल दावे में 12 साल बाद 2 नए प्रतिवादी बने उन्होंने अपने सशपथपत्र प्रार्थना पत्र में जिस संस्था का अध्यक्स होना बताया वह उस नाम की रजिस्टर्ड संस्था का अध्यक्स नही है। ऐसा उसने 2 कोर्ट में किया हैं क्या उसके खिलाफ 340 का action सम्भव हैं।
