Useful videos. Afraid very patronising video about men. Really, first point mentioned is to spend time with the kids? Then you move to comments like “immaculate conception”, and going straight to a comment “hey bitch”. Can we focus on the toxic women and what THEY need to do to STOP the damage to the kids! There is a small percentage of us, as in ME, a man….. who have got this…… have always had this, and met with societal matriarchal ideas that are out dated? Offended. Western Australia has its own Family Court system which is separate from other states in Australia. Contacting a WA family lawyer to discuss your matter is best.
My friend in Thailand is currently involved in divorce proceedings from her ex in Queensland. I am trying to help the best I can. On the consent orders form at the fcfcoa site, there are only three options for Jurisdiction: Present in Australia, Ordinarily Resident in Australia, and Citizen of Australia. Does this mean that foreign citizens miss out on property settlements?

Can grandparents be denied access if they have been having regular contact with the children prior to the separation……I guess what I’m asking is do grandparents have any rights or considerations in the conversation. We love our grandchildren very much and believe that we provide a nurturing environment for them when they are in our care, we never speak about the situation with their parents as we do not see that as our role. My husband and I separated after 28 years of marriage. He signed the house over to my name, and I wrote up an agreement where, as he would give up all rights and ownership forevermore to the house, and that he would keep his pension and equity for himself. we still haven’t divorced. Is my contract that was notarized and signed by both of us binding?
Hi Blessed Unless you entered into either a Formal Consent Order or entered into a Binding Financial Agreement where both parties received legal advice and were legally represented then your agreement unfortunately will not be binding on either party.

Are debts incurred and assets accrued after separation starts also subject to property settlement?
The answer to this is not always straight forward. The law is that all assets are included at the date that any agreement is signed or court order made. However if you can prove that the asset was acquired independently of funds or property that existed during the relationship then you may be treated separately from the pool. For example a person gets a car loan to buy a new car. Debts of the relationship will form part of the pool or any debt that has been created for the benefit of the relationship. For example if a person takes out a loan to renovate the marital house to sell it or takes out a personal loan to consolidate credit card debts then this debt will form part of the pool. But debts that won’t come into the pool are such debts as loans for a holiday or legal fees etc.

What if you both come into the marriage with seperate wills...and in my case as i dont know his...assets go to my children and one of my kids is power of attorney?
Firstly, It is important to remember that a will that was created prior to a marriage and not made in contemplation of a marriage will be void. As for the what occurs with step- children, the answer will vary from matter to matter. There are many factors to consider such as the ages, needs of the children, disentitling conduct. This is one which is best left for individualised advice.

The Family Courts are the feeding chamber to the legal industry. un-necessary hearings, wasted money and time. Corrupts the corruptible and rewards the criminals. Incompetent judges are so out of touch with reality. For a Law that no one even knows the details of until they are faced with the greed of another, this service should be free. Why are families and couples expected to know the details of Family Law act when going into a relationship. Why are they then dragged through the arctic system that only breaks people....and what gives these people who make these judgements so much power.
You are so correct it should be about healing not harming.
What is meant by "pay your own bills?" What if one party is a house husband and was relying on the income of the other? How is that party supposed to pay their own bills? Or do they have to come to an agreement based on affordability, which puts the non income earner (or lower income earner) at the mercy of the higher income earner? Or is the lower income earner not allowed to initiate divorce?
Thank you for your question as it is a common question that comes up when you have a relationship where one person is the main income earner and the other relies upon their income for support. The purpose of property settlement is to sever the financial arrangements of the parties and this means that each person has to support themselves by their own means. There are some circumstances though where it is necessary for one person to provide financial support to the other person for a limited period of time in order to assist the other person to get back on their feet and to upskill themselves in order to obtain employment. This is called Spousal Maintenance. In order to be eligible for Spousal Maintenance 2 things needs to be proven: 1. That the person who is seeking support has outgoing expenses that exceed their income; and 2. That the person who is to pay the support has the reasonable financial ability to pay the support requested. I hope that helps answer your question.
My wife and I have been separated for almost a month now. I have moved out into a caravan park. It is such an honour to know my videos are helpful. I love to empower and share as much knowledge as I can so that everyone has equal access to the legal system. In answer to your question it will depend on whether the Consent Orders are Parenting or Property. If you have a document with a red round stamp on it which is something we call a Court Seal then yes you have a Consent Order. If you have a document that is called a Parenting Plan then that is NOT a Consent Order. I am assuming yours is a Consent Order. In order to Amend a Consent Order you will either need the consent of the other party or you will have to commence court proceedings and seek a Court Order. If you do have the consent of the other party then you will need to go through and complete An Application for a Consent Order and Minutes of Consent just as you did previously. The only difference this is time is you reference the previous Orders and ask for either the whole Previous Order or specific Orders contained Previous Order to be set aside and then you write what Orders you are seeking to be put in place this time. If it is property Orders then I strongly recommend getting legal advice before doing so as there may be more documents or other issues that may need addressing. It is important to get lawyers to always do a check to make sure it has been done correctly and you are not missing out something important. Brother, one thing, after how many days does the divorce take effect in Australia, it means after signing the paper, the court that submits it, then it takes 3 months to get the paper or it takes more time.
It usually takes 3-4 months for a hearing date to be set once the application for divorce has been filed with the court. Once the court has heard the application, the divorce takes effect 1 month and 1 day after the hearing date
That Australian family law requires property pool inclusion of POST-separation (legally defined date) inheritance is astoundingly screwed up.
I can understand your point of view. Post separation contributions can be a bit tricky from time to time. Inheritances that are received after separation are included in the pool however the person who receives the inheritance may potentially receive most if not all of the inheritance depending on the individual matter. Unfortunately our family law system has some way to go to reflect a truly just and fair outcome for all of those who need it.
They can’t even sort out the MOST basic efficiencies, like the consent order proforma that USED to autocalculate (sub)totals. One now has to do it manually. Even a back of the envelope (low) estimate puts that legal cost to parties at $35 mil AUD/year! Something a middling Adobe-proficient admin staffer could do in a day (including QC).

Yes broken everywhere. They see the most extreme cases and then apply that logic to every false allegation case dragging the entire family through hell in the name of 'safety'. The results are homelessness bankruptcy and ruined parents. As long as one parent chooses to use the system everyone suffers.
