I have recently executed transfer on death deeds for each of my two nephews of single family houses in Seattle owned free and clear. One nephew is married and is expecting a baby shortly. If his family decided to move into that property, what steps would he need to take to avoid having it become community property? I'm supposing that the marital community could pay the taxes, insurance, utilities, maintenance and repair of the house, since the fair rental value would be considerably in excess of that sum. The difference would be a gift to the marital community. What about improvements -----the big kitchen remodel, for example? That sounds like an opportunity to comingle separate property with marital property. If so, how would you avoid that? I'm really just guessing though. Any comments would be welcome.

I think if he didn't pay it just move on. It's not going to get any better and as far as the Court's getting involved at this point, I think the courts get too involved with us anyways after 5 years. Hopefully if she's 18 and move down with her life, the court should no longer be allowed to be involved between the parents

I work as a paralegal and had a similar case. Parents had 50/50 with mom having primary physical and lived in two different cities. Dad remarried to a woman who had a bunch of money from her family. Mom had the kids in school in her city and was a nurse. Dad wanted full custody so that he could put the kids in private school in his city. The attorney's argument was essentially "look at how much my client and his wife can give these kids with all their money" When I tell you I had never seen, and haven't seen since, such a scathing order from a judge denying a modification of custody.

I just watch a zoom hearing where rights were terminated in Michigan, although different state, these parents were divorced, dad threathened to throw in the white towel concerning child, mom claimed to want the child but the crime of these parents were apparent lack of love and concern and a very self-absorbed mother, both were not compliant with most all recommendations from court to help their case, thankfully these rights were terminated.
