    My neighbor died in 2020 a few months later her daughter died, I went to the Sheriff's Department and let them know i was taking over the property, I was given a thumbs up and was told good luck. 2 day's later I went to the police department and told them the same thing I told the sheriff, I wasn't given the thumbs up but I was told good luck so i went to the house and moved in. The person that lives across the street from me is a police officer, he saw me outside and came over to question me but I told him that he has to study the law and he got very offended. Later on that night around 2:00am in the morning there was banging in my door. I went out on the porch barefooted and thats when i saw that the house was being surrounded by his co-workers. The way they did me was (Not Law Full) but some of them has prospered greatly since then. Leave me a comment if you care to know more.. Be Safe and TRUTH FULL 😉

    Is adverse possession possible when the individual on title is deceased and has no next of kin? This is in the context of California civil law.

    So if i am using / living on some land that is tied up in heirship, I've paid the taxes for the last 25 years, have a small house on it and have spent thousands on the road into it over the years. None of the family has touched foot on it for at 15 years. Some of the family members have signed tgeir part over to me years ago. Ive posted it, fenced it, improved the roads, payed the taxes, built on it, and live on it. Theres hundreds of heirs, most dont even know it. Can i use adverse possession to get a title to it?

      The case you describe is textbook and is the type of thing this law should support. Sadly this law is being used by sheisters to steal land from present, tax paying, true land owners who are simply trying to be patient neighbors while not understanding how self serving and sneaky their neighbor is. Your case is a good case and should not be a problem. Although there is a sa good reason for you to avoid filing for quiet title. Seems like you have well established possession that meets all the elements and and no one contesting it. So why not let sleeping dogs lie? Why not just sit back and enjoy your land knowing you met the elements of adverse possession? I am no lawyer but I understand this stuff because I am a victim of it and if I were you, I would just sit back and enjoy knowing that if they ever sue to eject you, the court will immediately award you title.

    Ya gotta love these lawyers. Every aspect of this law both statutory and common law, revolves around you lose your land no matter what. Even the defenses are bs. Breaking continuity -- right (gimme a break). How do you do that/ Give permission. End hostility? Give permission. Then you give permission and the entitled sobs refuse to acknowledge permission and in court you find yourself trying to prove you actually gave permission. Lawyers are heisters. So are judges. There is no defense against adverse possession if someone is committed to taking your land. Private property rights are NOT sacrosanct. Taking land from people is. I have two sheisters next door to me that are going to take my stream and woods in about two years and there's not a damn thing I can do about it. I found them sneaking around trying to make their hidden improvements plausible deniable open (i.e. making them slightly visible for the camera but not for me to act on). I asked them to move them and they gave me double talk answers so I offered them permission in the form of a letter (license) and they freaked out at that idea. They would not commit to it. The case law shows if you eject an adverse possessor from your land it can trigger and early counter suit where the judge may award title to the adverse possessor at the time limit for the state because the cases usually dont advance very fast. If you won some property and some thief next door wants to take it they're gonna get it. All it takes is a few statements, an invoice or two from a landscaper who id one or two things and that's all she wrote.

    I have been living in this old house for 13or maybe even 15 years now & have always paid my rent never an issue so my landlord has sold alot of his land & I have always had very good well water here so all a sudden he has decided to sell this land my home sits on never no notice no nothing & the man he has sold it too has turned off my water for 10 days now I aint had no water the man cut the lines coming to my home & capped them off so I still have not gotten an eviction notice no nothing & the landlord said I can stay here til January of 2023 but I need hip replacement really bad I have to use a walker cause the pain also shoots down my left leg which the doctor says is coming from my back .They have left me in a bad way is that legal what they have done ? I been they never even told me the water was going to be cut off just done it no warning no nothing that their way of getting me to leave quicker & I live on a fixed income .No way can I move right now nor can I afford the rent people are charging nowadays .I live in TN

    Being a landlord is tough especially if you rent to low-income/ high-drama tenants. Renters (during the "honeymoon stage) are so grateful at first if you give them a chance but thereafter they often degrade. They add unauthorized occupants or they start using a propane tank for heating or they start smoking inside (or both!). They eventually start littering and hoarding trash. They acquire pit bulls and of course they stop paying rent. Most of all, their gratitude converts to hostility. The more abusive they are to themselves, their environment, the more they project blame onto even (and sometimes especially) the most caring landlord. I have been a hands-on landlord for low income for over thirty years and I need to quit. Seeing that the government can take away my property owner rights i.e. using eviction as the only big stick I have to maintain control, I have decided to empty out my multifamily rental business. As the law leans harder on landlords and lighter on tenants, and as the law demands more complexity in record keeping etc., the job gets harder and harder for small landlords. I wish I could have heard more gratitude from tenants that enjoyed various periods of time renting in a place that provided for their needs when they had nowhere else to go. But since their lives continue drama, they find their landlord to blame. I presumably should not expect tenants to continue following rules or paying rent when they have issues in their lives. I can't tolerate the hate I get from renters any more. So those who see empty homes that could have been rented... maybe it's that other landlords have quit too.

    I was addicted back in 2019 because I wanted a toilet fixed the tank was seeping water I ended up getting evicted and I couldn't find any legal help on my side at all I called every lawyer in the town I called access to Justice I went to Dakota legal Plains I called the attorney general no one would help me I am on disability I have no car I had to get rid of everything I had I lost my section 8 housing the person I rented from used to throw people out for no reason just so she could steal belongings from them and nobody cares

    How about the biggest issue of all. How theres any where between 18-16 million empty homes and apartments across the US while theres 500,000-2 million people who are homeless (50,000 of them are children). Or that in the major cities where a person as to work 2 jobs just to rent a 1 bedroom...

    You already have to pass a background check and if you raise the age to 21 from 18 then military service age should be raised as well. Also that's a lie that you can buy a gun in another state if you're restricted in your home state. Purchasing a firearm out of state or online requires you to ship to your state and pass a FBI and NCIS background check before the sale is final

    I had a rail come out of ground due to neglance of the company. I got a lawyer after 2 years he goes before the judge to quit my case a 15 sec video. My lawyer is mailing me my files n not taken my case. He said I can seek counsel he afraid lose. I have over 500 hundred thousand in medical. N no settlement of medical or for a rail that hasn't was broken. I've had multiple surgeries due to this accident. So jack in the box gets to have neglectful properties n it's ok. I'm at a place where I'm not sure what to do next. Left with lot of therapies neck got Tatium in my neck due to disc that started leaking. Ughhh help

    I don't care what client and attorney agree upon. There is no way, that let's say, a settlement for one million was agreed upon with insurance company and Dr bills were 400,000. The attorney should not get 33 percent of the one million. He should only be entitled 33 or whatever percentage of what's left over after Dr. Bills. There is no damn way that after Dr. Bills are paid attorney should get 330,000. And client recieve only 270,000. I consider any one that does that a snake. How do you look your client in the eye after that.

My arrest was completely unfair, wasn't read my rights until after I'd been in a cell for a couple hours & then once I was brought to an office room for a recorded interview I finally was read them. No call, I was there from about 3:30pm til after 8pm. Thought they were doing this all for 2 grams of weed I had, found out when I sat in front of the judge on the tv and they handed me paperwork, that I was being charged with stalking, possession of a controlled substance, possession of drug paraphinelia, & harassment by communication.... Judge wanted to give me 10k cash bail. My mind was blown. Cop told me nothing when taking me in, didn't want to listen to what I said was really going on, just let it go in one ear & out the other. Didn't let me show him the evidence on my phone to back up why I'm there & our conversation leading up to it. In the recorded interview I told the guy I can send them the evidence that backs what I'm saying, he said they'll just get a warrant and download the entire contents of my phone which I think was for malevolent reasons including "thinking" they were taking away any evidence I had for my defense, still haven't gotten it back it's been 4 weeks. Had an online zoom preliminary that went about 4mins long. He asked if I had a lawyer I said no but I still have all the evidence backing up everything I've said & proving my innocence & their lies. He said ok we'll go to trial... There was a female prosecutor that chimed in real bitchy saying something about charging me with stalking & acting threatening. Nobody provided any proof of anything & nobody cares what I had to say so far through all of this. Then had a pfa hearing after that & that blew my mind... She provided no evidence, a really bad 2 minutes of accusations that when my turn to speak I immediately told the truth corrected it all, said I have plenty of evidence showing that, even evidence from the plaintiff herself multiple times stating everything I've been saying since day 1, that I've never hurt her or lied to her, that she's never had to fear me and I'm the only one she knows she can trust, & the nature of our convos for these "harassing & stalking" accusations. Gave her a fat folder of printed copies & told her that's just a tiny bit of the evidence I have. I spoke from the heart, never lied, nothing I said was ever disproved or questioned once, I had proved that what she was saying was not true with my evidence & testimony, judge tried to get me to agree to a temp pfa & I said no. It's obvious to anyone here whose telling the truth. So she took 10min & came out, I asked to speak one last time so I could point out how bad her lies were when she got last word before the judge took a recess, shattered that BS, & the judge says "I believe ****'s statements today & I believe under the law that Mr ***** did enough to rule under abuse, I'm granting a 1yr pfa"... It was a complete joke. I don't think anybody in that courtroom was expecting her to say that. So if the pfa hearing can be completely obvious & one sided with truth & evidence & I still am charged, then they are going to try & bury me for whatever they can get away with for the next trial... No idea what to do. Oh & my evidence proves that her "family & friends" around her are involved in using her as a cash crop slave & a lot of pedophile stuff with her daughter. Which I think is why the police & court are protecting things & smearing me.

    I have a Misc Case and I have never been given the option of mediation...even though I asked for it at least 3 times. I have also never had a trial, 2 attorneys, and 3 judges. What is really done with false allegations? Perjury? Parental alienation? Pro bono anyone? Because I am financially devastated. However, I have not seen my children as more than a visitor since Dec of 2016...and I pay my former abuser child support.

    If a person forces their significant other to take the loan out on a car because the SO has better credit, and they are not married, but the original person is the primary user of the car and does not pay on it...then goes into a court room for custody and tells the judge that they were forced to put that in their SO's name because they are painting a picture of the SO as being abusive? Who is really the abuser?

    The law does not dictate what a person is obliged to say in such a situation. Neither encouragement or discouragement is mandated. By equating encouragement with criminal action it does become a matter of free, or better, protective speech. Also if speech is action the law should stipulate what is criminal and non-criminal speech in such cases. Which is preposterous. I can see no way they can make this argument or sentence work and expect the verdict to be overturned and Michelle Carter acquitted.
