I've been involved in law for many years and I must say I'm very surprised that a High Court judge would rule that another band/business could use a registered and granted trademark of the original established band/business using that name which was started by the original founding member and supported by the other founding member. Usually once a trademark is granted in UK law, no-one can use that name for any commercial activity that is similar to the scope its granted for, ie in this case the name of a music group and music performances or recordings. I can only assume the case was poorly presented in court and the judge was confused by the two bands using the same name for 4 years (part of the 4 years with members of the original band in both bands). And whether Van Day did have any contractual aagreement or partnership and joint-rights over the name. So probably the judge decided more time was needed for either side to prepare their case before he could make a decision. I think the original court application was for an injunction to stop David Van Day's band using the name temporarily pending a full hearing. And perhaps that injunction was denied and the judge suggested a full hearing to weigh up the case. Again though, once a trademark is granted by the UK Office for Patents and Trademarks it's a pretty open and shut case usually. The holder has exclusive legal rights for music, performances and a band name. Van Day could have objected to the granting of the trademark and disputed it via the Office directly (rather than going to court) that's the normal procedure. Usually trademarks and patents can be disputed for around 18 months to 2 years after being granted via a dispute process. Then it's considered by the government office. THEN you go to court after that fails, if you feel that decision wasn't right or fair and have evidence to back up your claim to the trademark.
