The Netherlands - Floods, Dykes & Duties
How is the Netherlands preparing for sea-level rise?
Did you know that 26% of the Netherlands is below sea level, and 60% is at risk of flooding? The Dutch have a long history of battling the forces of water, turning challenges into opportunities.
But it's not just about dykes and dams anymore.

    Great video! One question - what is the UK doing to help reduce Shell's emissions in line with the Dutch court ruling?

      Thank you! The UK has a couple of climate laws and policies, but none of these specifically order Shell to reduce its local or global emissions. A case was filed against Shell's board of directors in the UK, inspired by the Dutch court's decision. However, this case was dismissed (see: www.clientearth.org/latest/news/we-re-taking-legal-action-against-shell-s-board-for-mismanaging-climate-risk/).

      @@madhusanadhya2514 Hey! Thank you for your comment. Transitioning from political science to a PhD in law could be tricky but it is certainly not impossible. Did you try to use some of the tips I gave in the video about the application phase? For instance, are you making a list of all the scholars you would like to work with around the world and reaching out to them?

      Hi there! Do you mean a PhD supervisor or a mentor who will support you in getting into a PhD programme? If you are looking for professors who can be your PhD supervisor, you can simply find them online and email them. As for a mentor who can facilitate your applications, there might be paid professionals who can help but I am not aware of any personally. Good luck!

      Thank you for the question. I’m not in a position to give you a good answer, it depends on the particular situation the person is in. Universities usually have (free) mental health support centres which can be really useful.

      @@pop-uplaw Thanks for the reply, i understand. The problem is that I can't even give a good interview to get into one. Panic attacks caused me to forgot some things that they've asked me about my subject. It was embarrassing to be honest, LoL. I think i need mental health support even before taking interviews. I don't know how it will work for me. Since the pandemic is over, i don't have any excuses left for not doing PhD anymore. Lol.

    I would sue my government (Australia) for facilitating the export of huge amounts of coal and other fossil fuels - by doing this they are harming the heck out of future generations for special interests.

    How do countries agree on their borders over hundreds of years? I'm guessing in the past they would just say 'bla-bla river is the border'. But technically rivers, mountain ranges, coasts, etc. are all continuously changing and this could have a noticeable impact on territories after 100 years.

      That’s a great question, thank you! Technically speaking, territorial borders might have been determined as a result of a peace treaty following WW1 or WW2, or sometimes it can date back to a treaty between colonial powers. For instance, in a territory dispute between Botswana and Namibia, the International Court of Justice (ICJ) referred to a treaty between Germany and Great Britain concerning the disputed territory. Maritime delimitation can be as tricky - the ICJ decided on the border in the Pacific Ocean and the Caribbean sea between Costa Rica and Nicaragua, by interpreting a treaty from 1858, supported by expert opinions. In a nutshell, countries agree on borders through diplomatic means, and in case that doesn’t work, they always have a court to go to!

    In order for a company to be willing to spend potentially billions of $, there must be some way for them to make a profit. They aren't necessarily going to just donate the money to jump start everything. I think they should be able to own what they pay for in order to get space exploration and settlement building going. Not completely without government oversight, but if you want something to get done, there is nothing like the human drive to turn a profit to bring out our ingenuity.

      Absolutely! How we structure "government oversight" is still a point of debate. One idea is that there should be an international body that oversees the mining process. Another idea is that each country should oversee their own citizens (including companies). The Moon Treaty calls for a common heritage approach, which ideally leads to establishing an international body. We are already following this legal structure for deep seabed mining - the International Seabed Authority is organising, regulating and controlling all mining-related activities in the deep seabed. So it is not left to the discretion of individual countries. What do you think about these two ideas? Do you think we should establish an international body to oversee outer space mining, or is what the US, Luxembourg and the UAE doing a better approach?

      @@pop-uplaw I think it should be an international body, as this would keep the regulations consistent for everyone. Otherwise, you end up with potential disputes out in space because country X allows something that a company from country Y isn't allowed to do. That, or companies build/buy subsidiaries in another country so they can do things under the rules they prefer. This also gets the arguments over what should and shouldn't be allowed in space potentially worked out before they can become a problem in space. There will probably always be disagreements, whether in an international body or in space, but maybe doing it this way will help keep things stable in space so companies feel more comfortable spending the large amounts of money to do things there.

    Why would mining companies expand activities off earth? I would think the tech involved in mining in space is very different.

      The increasing trend is to utilise the experience of the "on-Earth mining companies" to encourage "off-Earth mining". For instance, in Australia, the Off-Earth Mining Forum brought together space companies and mining companies to lead activities in this new frontier. Luxembourg set up the European Space Resources Innovation Centre, and the community includes mining companies. My interpretation is that we will see investors from the mining sector increasingly interacting with the space sector to engage in outer space mining.

As for States' obligations under the Paris Agreement, are they bottom-line standards for member states compared with standards of other international instruments (like the EU-China Comprehensive Agreement on Investment or CPTPP), What's the relationship between environmental protection standards of these treaties and the Paris Agreement?

      Thank you! The Paris Agreement only relates to climate change and aims to limit the global temperature increase to 2 degree Celsius in this century. There are other international/regional/bilateral treaties concerning the environment. Alongside customary international law, these treaties make up the international standards in relation to protecting our environment. The integration of these standards to investment treaties is relatively recent and follows the raising awareness on the environmental damage that can be caused by investors' activities at the host State. Stricto sensu, the Paris Agreement creates the obligation on States to prepare "nationally determined contributions". It does not create obligations for investors or the private sector. However, by way of determining their nationally determined contributions, States will surely develop policies that will impact investors. I hope this answer helps!
