Is the civil trial system past its use-by date?
This year's Macrossan Lecture 2024 is delivered by The Honourable Geoffrey Lance Davies AO at Banco Court.
Find out more: law.uq.edu.au/events/macrossan-lecture-series
There are two serious problems with our civil justice system. Both involve cost.
The first is that the vast majority of actions which are properly amenable to resolution before a judgment by a court tend to be resolved only at trial by which time huge and unnecessary costs have already been incurred by all parties.
And the second is that a trial under that system is beyond the financial capacity of most of those who would use it. And consequently they have to drop out.
The lecture discusses both of these problems and suggests reasons for them and ways in which they can be eliminated or at least substantially ameliorated. In both cases these involve radical reform: the first involving much greater judicial control over the pretrial process; and the second requiring, at least for most litigants, a simpler and cheaper system of trial.

Pro bono, which is short for "pro bono publico" meaning "for the public good," refers to the provision of professional services without charge, typically by lawyers, for individuals or organizations who cannot afford to pay for those services. Pro bono work is important for several reasons: 1. Access to Justice: Pro bono services help ensure that individuals who cannot afford legal representation or other professional services still have access to them. This promotes fairness and equal access to justice, regardless of one's financial means. 2. Equalizing the Legal System: The legal system can be complex and intimidating, particularly for those who lack resources. Pro bono services help level the playing field by providing legal assistance to disadvantaged individuals and groups, enabling them to navigate the legal system and receive fair treatment. 3. Serving the Public Interest: Professionals have a responsibility to contribute to the public good and serve the needs of society. Pro bono work allows professionals to use their expertise and skills to address social issues and contribute to positive change in their communities. 4. Professional Development: Engaging in pro bono work can enhance professional development by providing opportunities to work on challenging cases, expand skills, and gain valuable experience. It allows professionals to broaden their networks, build relationships, and strengthen their reputation within their field. 5. Ethical Obligation: Many professional associations and codes of ethics encourage or require their members to provide pro bono services as part of their professional responsibility. It is seen as a way to give back to society and uphold ethical standards. 6. Public Image and Social Impact: Organizations and professionals that engage in pro bono work often gain a positive public image and reputation. It demonstrates their commitment to social responsibility and can attract clients, customers, and employees who value and support such initiatives. Overall, pro bono work is important because it promotes social justice, equal access to justice, and the well-being of communities. It allows professionals to contribute their skills and expertise to support those in need, while also benefiting their own professional growth and fostering a sense of social responsibility.

And all this by the law of the commons & cultures in deciphering and countering the constant attacks by the nefarious cancerous greed of corporate deceptions. We can learn so much from her speaking and her books. What a blessing she is to humanity!

REALITY! Flatulence (Methane) from animal herds provides important nutrients for trees and vegetation Methane is short-lived in the atmosphere as it combines with water vapor and comes back to earth as rain, where Methanotpic bacteria break it down to nitrates in the soil for plants and trees. It is an important natural part of the earth's biosystem and can be replicated scientifically. C02 is broken down by photosynthesis feeding vegetation with carbon water and releasing oxygen. The majority of the methane produced by insects is close to the surface of the ground where bacteria break it down into nitrates. However, methane produced above the surface plays an important role in nitrate production for trees and is captured by tree bark and broken down by Methanotpic Bacteria into nitrate fertilizers for trees. Sobar look at the dangers of Carbon restrictions to all life!

On Death by Suicide Good Neighbours! What would you prefer I do to tantalise you all? Would you like me to do DIY Drop or Suspension Hanging? There's a difference;) Death occurs differently in each method. It's important to research the final moment before consciousness is lost. If anyone were upset reading this it would be because they couldn't slap me about while I was still conscious though not consciously still;) You see death is a paradox and dead men tell no tales. For they are the most truthful of those who once lived. It's in the absence of consciousness that the truth of conscience is revealed. It's in the gaps and disclaimers, absences and unsaids of the dead that the nature of truth is most saliently revealed. There is no truth. I think that is what the moral relativists were trying to imply. So death has a whimsical poetry that's quite witty. After all, it is the last laugh. He who laughs last laughs loudest. That's why most are happy and laugh as they hang themselves and realise terminality. For laughter is the best medicine:)
