    Hi Mike. I always try to recommend people to Google 'Statutory Guidance for the 2021 Domestic Abuse Act' as in my experience Police and Social services, Housing and Victims aren't familiar with the knowledge. It's incredibly useful.

    You can refuse the offer and get another offer? Since when? For me and my daughter the first offer was the last offer. I don't know if different councils have different policies on this, but I doubt it.

      It depends on the small print of the offer, in this case, the council had said (in writing) she could refuse an offer, then made a final accommodation offer - most likely this was the result of poor staff training rather than policy, but her refusal in this case was reasonable given that she'd just been told she could refuse it. Ordinarily refusing a final offer is the end of the line for that application unless you can show the offer wasn't suitable. But there are other offers in the mix which refusing won't be the end of the line (even if the council says it is). An example would be where the offer of accommodation doesn't meet the standards of a final accommodation offer or final part 6 offer, in which case, there would be further assistance available if the applicant is in priority need etc.

    I’m on the relief duty stage now I’m on day 46 my application has Been passed on to the private sector but I heard nothing from the private sector an nothing from the council since, I will say something on day 57 hopefully I can move on to the main duty

      The council should have given written instructions of how to ask for a review of the suitability of the accommodation. If they didn't you can complain.

    I’m currently been given the relief duty the 56 days is coming to an in the next week or so, the council said the 56 days is just a guiidnline and those no time set for when the relief duty ends

      not if you're owed the main housing duty - the statutory Code of Guidance is very clear there is a time limit and that decisions should be made on day 57 after the relief duty started except where there are particularly complicated circumstances, in which case the council can take an additional 3 weeks.

    That's some great info there. So if a tenant has received a S21, informed the council via email about this, has been assigned a HO and then negotiated themselves with the landlord to be able to stay for a bit longer if they haven't found a place in the private market, would this make it easier for the council to find a flat either in the private market or social? If the council for example negotiates with the landlord again and the landlord says it's fine for a couple more months, wouldn't they then not just say: ah, you no longer are homeless. See, ya. Just wondering. One would think that if the landlord is cooperating, then it would it so much easier (and cheaper) for the council to get people rehoused.

    Local connection lives in there own holiday home witch cannot be lived in all year they must leave 1 day every month and council say they can’t be local connection as they don’t legally live there so how can you go abought this when they do live there 3:08

    hey guys my friend sent letter to housing in few days ago got a reply back saying to ring this number housing options team. rang the number told them the situtation got told there a housing crisis and they have to sign a declaration of homelessness in a meeting in face or on the phone on the 28th feburary ? not sure if this is normal practice?not sure what will happen on the 28th of feburary will the 56 days start from then ? has it started already. had to make another homelesness apllication on the homechoice so i did that also. got an email back saying-----Thank you for submitting your enquiry/documents via the Housing application enquiry form. We will be in contact with you as soon as we can, and this should be within 28 working days. not sure what to make of it all can you shed any light onto what the next steps will be

    Thanks for the video! I was given a section 21 yesterday & I have 2 months to leave the property . I did approach my council about this & they said I can make a homeless application only when my landlord has gone to court with the final order & balliff comes to evict us . Then they will help. But I have 2 young children & am 6 months pregnant. What advise can you give me ?

    A friend of mine, in her third trimester, originally from Guildford, moved to Lewisham Borough for six months due to a domestic issue (it was a settled accommodation of a friend of hers for 6 months someone she said could potentially be the father of the child but out of shame, she doesn't know 100% and doesn't want to involve them seeing as she knows that could potentially lead to more problems with her relationships and application etc.) , then to Greenwich Borough, where she has been sofa surfing and occasionally staying with a friend for over six months. After Lewisham said that they did not provide emergency housing, she requested a transfer to Greenwich, where she felt more connected due to her friend. Greenwich, provided emergency housing in a B&B but has questioned her local connection, despite her providing her friend’s address and contact details. She had raised concerns about discrimination and negligence in her case, such as incorrect details about her pregnancy, leading to tension with the council. In retaliation for her complaints, Greenwich appeared hostile, providing housing options she cannot afford due to her lack of income (she is on Universal Credit, pregnant, and a single mother). Now, the council is trying to return her to Lewisham based on the argument that she lacks a local connection to Greenwich, even though she has lived there for over six months. Her caseworker has stated that after further inquiries, the council plans to discharge her housing duty, offering her privately rented accommodation, which she cannot afford, citing the five-year residency requirement under the allocation policy. As a result she felt that the council was treating her unfairly and asked to be referred back to lewisham since the council were challenging her about her local connection so much so that it was causing anxiety and health complications with her unborn child. to give you some more context on lewisham , she was living in lewisham borough for 6 months out of the year, January 24-June 24 however she is registered as having employment there, getting her Universal credit there as well as having her hospital and midwives registered in the borough. the main reason she approached greenwich in the first place was due to sleeping rough and the fact that lewisham didn't offer any type of emergency shelter - furthermore lewisham closed her case and then reopened it after they came back and said they had found a local connection after all, this caused feelings of uneasiness so she thought to try the new borough where she had been residing to help her chances- the real question is - she has 10 weeks left to go , nowhere fixed to stay and she needs to know which borough will provide her with housing (since she told greenwich to close her case) lewisham or Guildford which she originally resided at from 2015 and also has family in the borough, but cannot reside again at her family's address due to a past domestic dispute that involved police - thanks again for anything you can shed on this- she just wants to know if its worth going back to lewisham or if she should go back to guildford since she has resided there for longer - Lewisham have previously admitted that she has a local connection and she just needs to try and secure some temporary accommodation before the baby is born.

    I'm currently a full-time student, and my wife dreams of becoming one too. She plans to apply for a tuition fee loan and a maintenance loan, which she'll repay in the future. However, we've run into a frustrating issue with our local council. They claim that if we both become students, we'll no longer be eligible for housing benefit and could even face eviction from our temporary accommodation. The council argues that by making this choice, we would be 'intentionally homeless' because we wouldn’t be able to afford rent. It’s such a frustrating and unfair situation-my wife is stuck in limbo. She can't work full-time due to her current circumstances, and without becoming a student, she can't gain the education needed to secure better job opportunities. It's a vicious cycle that seems impossible to break. Does anyone else have experience with this? Is there a way to challenge the council’s decision or get support in this situation? Any advice would be appreciated!

    Hi Mike! hope you're good! Do you have any advise on how to secure a council/HA accommodation and to steer clear of being offered a 'final offer' in to a PRA? s193 has kicked in but with a 24 month bidding limit. Also bids seem to be 'restricted' a fair amount and most every week there are no 'eligible' properties to bid on. On the one off time an 'eligible' studio popped up, there was 143 bidders in front. Time can pass by quickly and it seems like this could be a plan to palm people off into PRA if there has not been a successful bid by the end of the 24 month limit. could this be likely? Thank you

    Hi, Today I received a section 21 notice ( FORM 6A) & it says that I have to leave the property by 14th march 2025. Which will be in the next 2 months . I am currently 6 months pregnant & by the time the landlord wants me out I’ll be heavily pregnant . I also have 1 year old & 6 year old. I have informed the council of this & have tried to apply for a homelessness application as I’ve received the section 21 but they said they can’t help me until the Bailiffs come to remove me & kids from house . Then they will help us . I wanted to apply now for homelessness as I will be heavily pregnant & have two young children . What could you advise I do ?

    I am trying to help a family friend who has been sofa surfing for a while and he has severe anxiety and depression. Currently taking meds and going through therapy. He is a single man 41 no kids. His 56 days relief duty ended on the 31st of dec 2024 but despite few emails the case worker disappeared . What can he do? He is on UC plus LWC . I’d be is being ignore what could be the reason?     Hi,im a guy in his 50s,ive had Heart surgery,im a carer for my Autistic brother,and i also care for my elderly mother(83) who is unsteady on her feet and frail. We've got 2 weeks before we're evicted,and we've found nowhere to go. The Council have said they'd help us,but times running out and we're all panicking now.     Hi, I made an application on 17.10.24 assessment done on the same day. The case worker replied and requested some documents, earnings, and expenditure forms. I used to check emails on a daily basis, but I don't know how i missed his email and after couples of weeks starts to call LA and find out update but I always get reply that you need to wait, your case worker will reply to you they gave me his email address where I send him GP letter and request him to reply. Later on, I sent him my documents, but I still haven't received any reply from the case worker? Any suggestions.

    I've used chat gpt recently where my local council have threatened to evict pensioners for not paying lifeline Charges when they either can't afford it, don't have it connected, don't need it and don't even have the Lifeline equipment in their property. The council demand the payment is a service charge, have hidden it in rent charges and refuse to disclose where the money goes. Chat gpt has given me a wealth of information and organisations to approach and highlighted what the council is doing to it's pensioners is not legal. Unfortunately despite the information provided the council have stonewalled me.

    If your rent is increased. Check what similar properties are being advertised for in your area. If your new rent is far higher then you can challenge it. If it is the new rent is in line with other rents then your landlord is being fair. I think it is worth remembering that for many landlords they are under increasing financial pressure. I have one property where the rent is £875 but my mortgage payment is £877 !

    I think any hostel that 'serves' as a TA should train at least one staff member the ins and outs of these laws, to support people with getting not only the right treatment by the council, but also their own long-term place. It would help a lot. I think there's many people who become homeless, go to the council, trusting that they know what they're doing and being fobbed off, taking the 'advice' for granted. People will say, go to Citizen Advice, which I've found in the past, utterly useless. Justice for Tenants advices to maybe sue the landlord (disrepair), but what good is that? You'll only aggravate him/her even more and that's gong to hinder your chance to find a place in the private sector in future. Can't even believe they would say something like that. Genuine problem is finding an organisation like Just US to help people in need. Is Just US open to any borrow?

      Contact your local councillor. Search the council's site and there will a section which gives all the councillors' details and what addresses they cover. Start there and copy them in to everything. The Council might try to make it difficult to email and instead point you to an online form, but try to avoid that as it won't give you proof that it's been sent.

    Let's face facts, if you challenge the council the power dynamic is hugely weighted against you but if you persevere there is every likelihood you will prevail. Keep at it, and don't lose hope.

    I feel like okay, you get compensation, but the suffering and the mental health implications are likely life-long. In a 'rich' country like England, I find it's unbelievable that such a thing exists. Giving anyone just a microwave to cook for the kids in a hotel! Just unbelievable. And putting people into places that are in disrepair ... Jesus Christ! On the other end there are flats sitting empty. Mindboggling. Also I know of someone who's been in TA for 8 years (flat). You'd think 1-bed council flats are likely more readily available.

      Absolutely. Everyone needs to be turning up at their local council meetings drawing councillors' attention to these kind of issues so it doesn't keep happening.

      Agreed, but I'm of the opinion that no one else cares enough to actually end homelessness - so whilst it shouldn't be necessary, if people get through it in one piece they are much better placed to push for change - if they don't we'll just continue to have an industrialised homelessness sector that is financially incentivised to perpetuate homelessness.

      Yeah I think there are cases where the LGSCO should be more understanding - I'm not sure what experience LGSCO staff have but I don't get the impression that it's co-produced with people who've been through the homeless application process. Don't get me wrong, my experience is that they are decent, it's just they sometimes give housing officers more credibility than they perhaps should be given.

    Refusing is the word. Reasonable is another they use. Ones in their own legislation they try to ignore is 'fit for purpose'.

    I have heard if you get help under the domestic violence law they have to house you outside of the town it happened in? Is that true? As I can’t go out of my home town due to support

    Yes thank you. I did make an application to my housing office after making many complaints about feeling unsafe. I did explain I am autistic with diagnosis. I was invited to a meeting with the housing association manager and a social worker whose nane I was not given. In the meeting I explained I would need help as I find it extremely difficult dealing with certain things online like applications and things like call centre conversations as well. Housing manager and social worker said don't worry your application is live. They said we will help. Next thing I got a letter saying something like it's not happening. I am overwhelmed with it all . Got even more problems so. It is what it is. I not got time or the brain capacity to deal with it all. Thank you. 💝

    Thank you for this video, I’m a single mom for 2 teen boys, one about to take GCSE on May, my landlord of 10 years served us notice through his agent . I’m already struggling with inflation, now I’m trying to finding a private tenancy is nightmare with unrealistic conditions & higher rent prices.     You're a wealth of knowledge. In case of being in the LCWRA bracket, you're not being capped. Would you also automatically be 'vulnerable' and maybe priority need?

      It wouldn't be automatic, but likely that there will be issues that could render someone vulnerable.     I got section 21 and made application for housing solutions (jigsaw) send all documents, bank statement, ID,letter of eviction, tenancy agreement all, they send me email for telephone call next week it will take 2hours they said

    Is there some sort of template I can use as a base for the complaint. I have a section 21 currently overstaying on relief duty. Trying to avoid court costs with no defence and council told me to wait till bailiffs. Me and 2 children autistic and I have physical disabilities we as a family wouldn’t cope with the trauma of court eviction let alone the debt when I can’t work!

      Omgosh that’s the best thing since Clive’s bread. I find writing letters and complaints really difficult so will likely use that a lot in future. Never used it before and that made it aoooo much easier!

    Thank you again. Though I will say that sleeping rough would affect anyone, 'normal' or not. I can't see anyone who finds themselves suddenly homeless, even with sound mental health, being all chirpy about sleeping on the streets, especially in the cold. Even sleeping in a shelter or being moved from YMCA and other weird accommodations will take a toll on anyone. I know that I can't deal with this, but I'm suffering from depression and have no idea what it feels like to have a 'healthy mind'.

      I'll do a video about how it works in practice. Basically, if you're homeless and approach Council 1 where you have no connection, but you do have a connection to Council 2 and it's safe for you to be in Council 2's district, legally, the Council must accept your homeless application, place you in emergency (interim) accommodation, carry out an assessment and create a PHP, and only then can they start the referral process to Council B. But pragmatically in this situation in most cases you'd be better off going straight to Council B.     Ive been moved to a emergencey accommodation for 7 nights in hunslow with 2 kids, im a single parent. My housing advisor said shes trying to get me into a private rented accommodation. She said i can carry on bidding on band b high priority on the housing register, which i have been on for 4 years. I said wont that effect my priority band if im in private wont my situation be aeen as nonurgent she said no. Im confused and unsure. She said temporary accommodation would prolong the bidding and actually getting a offer but private wont

    Modern tech dinosaur here too. I just tried using it a few days ago to overcome a Warrant of Possession. Fed in all of the details for the N244 form. Gave it the jurisdiction instantly i.e. England and I have to say the answers it provided were excellent. I asked it to provide my answers for the N244 form for me which info looked excellent, so tomorrow 9 Jan 25 I'll do the litmus test and see what happens when I ask for the Warrant to be set aside or significantly delayed.

    I have a very Unique case that's happened to a friend of mine - I don't know who else to ask - the Person in question is late into pregnancy in their 3rd trimester and had originally moved to lewisham borough (6month stay) after a domestic issue from Guildford and then into Greenwich Borough where she has been sofa surfing and occasionally would stay at an address in greenwich (this has also been for over 6months) after some referrals back and forth between lewisham and greenwich due to the fact that lewisham did not offer emergency housing and she was sleeping rough/sofa surfing , she asked lewisham to move her to greenwich where she felt like she had more of a local connection due to her friend who she would stay with sometimes. greenwich have come back and given her emergency housing in a b&b but have repeatedly been questioning her about her local connection to the borough even though she had already provided an address and contact number of the friend she was staying with. furthermore she has complained to the high-ups within the council asking for her case worker to be shifted after experiencing repeated discrimination as well as negligence toward her homeless application case (e.g. listing the weeks of pregnancy wrong) this in turn has made the council very hostile towards her as a whole with their intention to pass her on from the borough being made very clear. they have provided her with house viewing links for privately rented accommodation which she cannot even afford due to no income , she is on UC, a single mother with no partner support and unable to get a job due to being pregnant and now the council are trying to send her back to lewisham on the basis of a lack local connection - even though she has provided an address within the borough which shows her staying in greenwich for more than 6 months, in their bitterness about bing reported and being asked to transition caseworkers, her own caseworker has now notified her that after their "full enquiries are completed , the housing duty will be discharged into private rented accommodation . this is in line with the allocation policy as you have not resided in the borough for five years" this all feels very unjust and I feel like there is something more that can be done. should she go back to lewisham and try her case there or is there something she can do with greenwich that will make them have to house her somehow ?

      @@homelessnessbestpractice it was a settled accommodation of a friend of hers for 6 months someone she said could potentially be the father of the child but out of shame she doesn't know 100% and doesn't want to involve them seeing as she knows that could potentially lead to more problems with her relationships and application etc. to give you some more context on lewisham , she was living in lewisham borough for 6 months out of the year, January 24-June 24 however she is registered as having employment there, getting her Universal credit there as well as having her hospital and midwives registered in the borough. I've asked around further about greenwich council and all of the people are saying she doesn't have a strong enough local connection . the main reason she approached greenwich in the first place was due to sleeping rough and the fact that lewisham didn't offer any type of emergency shelter - furthermore lewisham closed her case and then reopened it after they came back and said they had found a local connection after all, this caused feelings of unsureness so she thought to try the new borough where she had been residing to help her chances- the real question is - she has 10 weeks left to go , nowhere to stay and she needs to know which borough will provide her with housing , either greenwich , lewisham or Guildford which she originally resided at from 2015 and also has family in the borough, but cannot reside again at her family's address due to a past domestic dispute that involved police - thanks again for anything you can shed on this

    Hi my friend is applying next week and had a few question on what to write on the letter. As there health conditions brain injury they have a girlfriend who helps care for them on day to day. How can they write in the housing letter that they need to be in the same area as she live currently. As I think they will be owed The main housing duty and priority need(they meet all the critera) I think they will be put on auto bid. They are ok with this but they would like to tell the council in the initial letter to make them aware they need to be in the area of there girlfriend. As if I was put on the other side of town for example she would not be able to get to them and help daily with making food etc. with cognitive dysfunction they need routine which they have with there girlfriend and they are comfortable with her. Is there a way they can make sure they can’t offer me something with is far away or outside of this area as they would rather make this clear before being placed on list and autobid How would I do this in a letter?is there anything on the housing law on this ? Also the property they used to live in with my grandad they cannot stay anymore he has asked them to leave should they ask him for a letter saying they need to leave his property? To avoid the question of saying am I intentally homeless? Also what is the best way to say to the council if offered temporary accommodation they don’t not wish to be put into some sort of hostel as temporary acommaedtion due to vunerabilittes in Leicester there is a lot of anti social behaviour. would prefer a self contained tempporary acoomadtion if possible.
