Is the fiscal's office considered as a "competent court"? The office of the prosecutors belong to the executive branch, that is the DOJ. Courts on the other hand fall under the judiciary. This being the case, may the fiscal's office be allowed to look into an individual depositor's account?

Who can and who should inquire on the source acct of the other transactions?

What about BSP Memorandum No. M-2021-059. Subject: Information Sharing for Fraud Investigations? Can this be part of the exemption and no court order is needed for digital bank scams esp due to urgency of the situation?

Atty., point of clarification po on exclusion of "non-bank person" if nkpagbgay po ang bank officer ang bank statement ng isang account to an unauthorized person, X, who likewise shared the bank statement to others, pwede po ba kasohan si X for violation of RA1405 for examining and disclosing the same to others? or si bank officer lg po pwede kasohan for unauthorized disclosure? thanks
