    I did some checking on your statement and you might want to clarify what you said about the gift tax. My understanding, and I'm not a CPA, is you don't have to PAY any tax on the gift until you reach the lifetime total exceeding 13.51 million dollars you simply have to file 1 more form if it exceeds 18,000 per person so for most people this isn't really an issue. So from a purely tax prospective it is,generally, more beneficial to have your kids on your accounts than not. I'm currently settling my mom's estate and have learned a lot about the tax implications. Your other points however a quite valid especially divorce and accidents.

    I'm in a different state than you but want to understand this so u can find someone licensed in my state. I'm (the trustee) selling investment real estate at a substantial loss property owned for 11 months. I know the shit term capital loss can't be allocated to the beneficiary (me), but left in the trust to offset future gains. Can 3 remove the property from the trust and deed back to me (before sale) so I can use the loss to offset the sale of my individually owned stock that has longterm cap gains if I sell now. Thank you for any info you can provide.

    What is wrong with this picture if you don’t use a professional team of arbiter validation certification family lawyers what is to keep a greedy relationship or dysmorphic attorney from rewriting it to get it?

      We always recommend using an attorney with experience in the particular focus area you need (in our case, estate planning and probate), a good reputation and transparent billing practices.

    Hi... I like your channel. Do all beneficiaries of a will know what the other beneficiaries receive? I believe a revocable trust was set up by my family member. Honestly, I'm curious if we will all know what each other will receive...percentages in particular..... Terrible thing to be thinking of right?.... Thanks in advance

    How can they not get paid? Are these clients forced on the lawyers by courts?

      Powers of Attorney are personally selected by the person whose estate plan it is. Most people discuss this decision with the people (often close friends or family) they are choosing in advance, so this would hopefully be part of that discussion.

    The need for new account differs by bank. Bank of America allowed me to keep my legacy account numbers in the bank and brokerage. It also segregates your accounts into Estate Services in on-line views when owned by a trust. The banking center can do it on the non brokerage accounts. The brokerage accounts require proprietary forms that your advisor sends you. It is very particular for every line and will likely take several iterations since the banking center where you take the completed forms are typically not trust experts. It will not do e versions though BOA does e versions for most other changes. It might be different if I created a Irrevocable trust with an EIN vs. my SSN. Having been executor twice, funding the trust required as much work as handling assets through a will. The difference is no judge in the process. You do not save process time, but the process goes more quickly.
