Hi , my father and his brother have same survey number and unpartitioned land , and the land is on my aunt's name , we want to partition land according to shares but they're not agreeing reason we have shares in 2:1 ratio , major on my father's name, so if land is partitioned in 3 parts only 1 part will have 2 roads attached and other 2 parts will have 1 road attached , and both parties want that 1 part as their share we tried to convince them because we have major share we will take that but they're not agreeing for that so is there any solution for this problem, if yes whom can we approach for help regarding this issue please reply

Correction: In Muslim personal law if wife dies leaving husband and children behind, all of them are the inheritors from her assets.

Most property of NRI's before they can claim it has already been transferred to someone else in the State's records. That has been my experience. The property was transferred illegally in a third parties name, a loan availed against it sanctioned by the Central Bank of India and finally when we tried to claim it the borrower just disappeared and was not found.Central Bank's Manager filed a suit against the borrower and then demanded that we pay off the Loan of 25 lakhs plus interest and it took years to get the case resolved. Most Bank Managers work hand in gloves with fraudsters.

My mother was a Canadian citizen, residing in Canada. She used to visit India occasionally. During her India visits she used to stay in the house that she inherited from our father subsequent to his death. Two of her sons had been living in that house. Five of her kids (one son and four daughters) had settled abroad. After our mother passed away, her sons are claiming that mother had made a will, leaving the house to her sons only. They have not shown or shared any information regarding the Will with sisters. They refuse to give a copy of the Will to sisters. My question is if our mother’s Will legal if she had inherited the house from our father. Should not the inherited property be distributed amongst all the sons and daughters. We have come to know the sons are planned to sign some documents to sell the house without girls consent. What does the Indian law say about it please?
