    Assuming there is nothing to the contrary within the contract which assigns the liability for the delay in some other manner, the liability within law would fall on the party whom failed to perform either time or product. The liability within law falls on the company contracted to provide the specific good or service at the specific day time/place. IF the general contractor hired all of the subcontractors they are managing their subs, the general should not be telling the subs to schedule amongst themselves. going to assume there a local inspector who does a structure sign off prior to Electrical being allowed on site. CORRECT? IF there are no inspection prior to Electrical being allowed on site, there still exists the fact that commencement of the job was not possible through no fault of your own. FWIW The general contractor is ultimately liable for the delay for not having the site ready on the day they told you the site would be ready for your crew. You had zero input, contract, nor oversight over the one who caused the delay thus you have no duty or obligation to catch the general contractor up in regards to the calendar. IF they have a crazy contract with tons of pages of specific performance parameters and goals, omitting something else "specific" is seen as an intentional action of the big company. MEANING -- ANYTHING not specifically spelled out regarding the assignment of liability for delays would be found in favor of the less sophisticated of the contracted parties (you the small Electrical Contractor). It would be an equitable judgement which would find whom was liable for the delay. If the general contractor determined that the delay is not suitable and would need to be absorbed downstream by subsequent subcontracted parties, the general should have fined the tardy sub and then asked downstream guys say I really need this done if I got you the money for another employee(s) do you think you could cut a few days off this job? I mean it would be pie in the sky dream if you could cut a week however a couple or three days would be awesome.

    I guess I don't understand, isn't it precisely a manager or leaders job to find the places where things are going wrong and the places where things are going right? should a leader ignore the places they know where things are going wrong because they don't want to seem too critical? That seems like weakness to me

    • @thetradesmanexperiencepodc5265
      @thetradesmanexperiencepodc5265 11 місяців тому

      I think it’s important to find both. Poor managers or chickenshit leaders focus only on the things going wrong. Those that focus on only things going right suffer from delusional optimism. So there’s a balance. The message here is what culture do you want to create.
